Ltd also known as Pocket52.com is a private limited company incorporated under the laws of India, having its registered office at 4th floor, No.1685, 27th Main Rd, 1st Sector, HSR Layout, Bengaluru, Karnataka 560102 India, where such expression shall, unless repugnant to the context thereof, be deemed to include its respective legal heirs, representatives, administrators, permitted successors and assigns, the creator of this Privacy Policy ensure our steady commitment to Your privacy with regard to the protection of your invaluable information. This privacy policy contains information about the HTML5 platform / Windows/ MAC /iOS/ Android app called Pocket52.com. In order to provide you with our uninterrupted use of services, we may collect and, in some circumstances, disclose information about you. To ensure better protection of your privacy, we provide this notice explaining our information collection and disclosure policies, and the choices you make about the way your information is collected and used.

We provide the service of HTML5 platform / Windows/ MAC /iOS/ Android app called Pocket52 and Pocket52 Lite.

Following registration, You can review and change the information You submitted at the stage of registration, except Your display name/ user name. An option for facilitating such change shall be present on the home screen of the application and such change can be facilitated by emailing us at support@pocket52.com. If You change any information, We may keep track of Your old information.

If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible, at support@pocket52.com. We shall promptly correct any information found to be incorrect.

To remove Your profile so that others cannot view it, contact our customer support at support@pocket52.com

We shall retain in Our files information You have requested to remove for certain circumstances, such as to resolve disputes, troubleshoot problems and enforce Our terms and conditions. Further, such prior information is never completely removed from Our databases due to technical and legal constraints, including stored ‘back up’ systems. Therefore, You should not expect that all of Your personally identifiable information shall be completely removed from our databases in response to Your requests.

1. CONTROL OF YOUR PASSWORD: (OPTIONAL)

When You register on the Application, You shall be asked to choose a password. You are entirely responsible for maintaining the confidentiality of Your password. It is important that You protect it against unauthorised access of Your account and information by choosing Your password carefully, keeping Your password and device secure by signing out after using Our services and exercising caution in disclosing Your password if needed.

You agree not to use the account, username, email address or password of another User at any time. Further, if You choose to disclose Your password to any Third Party, You are solely responsible for all actions taken with Your account information and password, including fees. If You lose control of Your password, You may lose substantial control over Your Personal Information and may be subject to legally binding actions taken on Your behalf. Therefore, in the event of loss of Your password, You should immediately change Your password. Further, You agree to notify Us immediately at support@pocket52.com. if You suspect any consistent unauthorized use of Your account or access to Your password even after changing it.

1. SECURITY:

We treat data as an asset that must be protected against loss and unauthorised access. We employ many different security techniques to protect such data from unauthorised access by members inside and outside Nirdesa Networks Pvt. Ltd. and other companies and third parties. We follow generally accepted industry standards to protect the Personal Information submitted to Us and information that we have accessed. However, “perfect security” does not exist on the Internet. You therefore agree that any security breaches beyond the control of Our standard security procedures are at Your sole risk and discretion.

1. INDEMNITY:

You agree and undertake to indemnify us against in any suit or dispute by any Third Party arising out of disclosure of Personal Information by You to Third Parties either through Our Application or otherwise and Your use and access of websites, applications and resources of Third Parties. We assume no liability for any actions of Third Parties with regard to Your Personal Information, which You may have disclosed to such Third Parties.

1. PAYMENT POLICY:

Definitions:

User: Person or business paying for a service via pocket52.com

User Account: shall mean a bank account or credit/ prepaid/ cash card account of the Buyer with the Issuing Institution.

Card Network/Card Brand: Networks that power credit card transactions. These include Visa, MasterCard, American Express and Discover.

The User will bear and be responsible and liable for the payment of all relevant taxes in relation to the Payments made under this Agreement.

User receive the amount (minus our charges) and net of taxes in their bank account within T+3 business days where T is defined as the date of intimation of the completion of the transaction.

Pocket52 Lite doesn’t not offer any real money deposits and is totally free to play. It does not require any SMS permissions.

When a user deposits any amount, 8% of it will be locked (not withdrawable, user will have to play on tables, and generate rake equivalent to locked amount to unlock entire amount. For one rupee of rake generated one rupee will be unlocked.

1. TDS

Section 194B of Income Tax Act states the following, “The person responsible for paying to any person any income by way of winnings from lottery or crossword puzzle or card game and other game of any sort in an amount exceeding ten thousand rupees shall at the time of payment thereof, deduct income tax thereon at the rates in force”.

On any net winnings, Tax would be deducted at source (“TDS”) at the rate specified as per the Indian Income Tax Act 1961 (as amended to date) or as per any other law in force at the time being. The winner will receive the prize money only after the above-mentioned deduction.

TDS is applicable at the time of payment, which is when a Player’s ‘Winnings’ are calculated. According to the Indian Tax laws, TDS on winnings from card games is on a gross basis, so players cannot deduct their losses and expenses to determine taxable income.

Thus, any net winnings are subject to TDS of 30% (exclusive of surcharge and cess) and payment to the player will be after deduction of such taxes.

The User hereby agrees and acknowledges that the winnings from Games, tournaments or through any other services as provided by the Website shall be allowed to be withdrawn only after deduction of applicable TDS. The User also agrees to furnish a scanned copy of his/her PAN (Permanent Account Number) duly issued to him / her by the Income Tax Department, Government of India, to deduct TDS as per the rules and regulations of the government of India. The User also agrees and acknowledges that deduction of TDS by the Website does not absolve the User from his or her overall liability to pay all applicable tax on his/her winnings from all games / tournaments played on the Website during the course of the year. The User expressly acknowledges that it remains his/her liability to calculate the total tax due to the relevant tax authorities at the end of the year and to pay any balance tax over and above any TDS that would have been paid on the User’s behalf. A Game of cards for a user ends once he/she withdraws chips from the User Balance and TDS, if applicable as per the regulations, will be deducted on the winnings at that time.

1. PROTECTION:

The services are intended to be used by only a person of 18 years and above. If Pocket52.com notices non complaining with any of their policies by any user, it has all the authority to delete the account of any such user. All balances in such account will be null and void with immediate effect and it will be at the sole discretion of Pocket52.com

1. SEVERABILITY:

Each paragraph of this privacy policy shall be and remain separate from and independent of and severable from all and any other paragraphs herein except where otherwise expressly indicated or indicated by the context of the agreement. The decision or declaration that one or more of the paragraphs are null and void shall have no effect on the remaining paragraphs of this privacy policy.

1. AMENDMENT:

Our Privacy Policy may change from time to time. Hence we shall post any privacy policy changes on the homepage of the Application/ notify you on your registered email with us.

We cannot ensure that all of Your private communications and other personal information (including sensitive information like credit card information and bank account number) shall never be disclosed in ways not otherwise described in this Privacy Policy. Therefore, although We are committed to protecting Your privacy, We do not promise, and You should not expect, that Your personal information shall always remain private. As a User of the Application, You understand and agree that You assume all responsibility and risk for Your use of the Application, the internet generally, and the documents You post or access and for Your conduct on and off the Application.
