According to Section 12 of the Public Gambling Act, 1867 (“PGA”), which games of mere skill are excluded from the purview of PGA. .

Legislation and Regulations

The overall jurisprudence governing gambling, including the legality of skill-based games in India, can be derived from the PGA. The PGA was based on the Gaming Act 1845 and the Betting Act 1853 of the United Kingdom. Upon enactment of the Constitution of India, the PGA could be applicable to a State only if such State specifically adopted the PGA.

Some states in India have adopted PGA with amendments and have restricted or prohibited all forms of gambling activities while making no exceptions for games of skills. Accordingly, residents of Andhra Pradesh, Gujarat, Assam, Odisha, Nagaland, and Telangana are prohibited from playing on Pockte52.
